Spodeli Terms and Conditions

When ordering from Spodeli, adherence to the Terms and Conditions is required. It is essential to carefully review them.

1. General Conditions

1.1ย  These Terms and Conditions apply to all customers of Spodeli. By placing an order, you agree to these terms and conditions.

1.2 All goods and services are provided in accordance with Australian Consumer Law. These general conditions are governed by the laws of New South Wales.

1.3 Delays and Force Majeure. We are not responsible for delays or failures in performance caused by events beyond our control, including but not limited to extreme weather, traffic accidents, or ingredient shortages.

1.4 Customer Conduct. We reserve the right to refuse service to anyone for any reason at any time.

1.5. When providing visual references for custom designs, note that the final design is determined by Spodeli's artistic discretion.ย 

2. Online Ordering without pre-approvalย 

2.1 Check availability BEFORE placing your order. If you order for a date that is sold out and you have not seeked pre approval by our team, we are under no obligation to fulfill your order. If we cannot find the time required to fulfill your order, it will be cancelled and your order will be refunded to the original payment method, minus a $25 admin fee.


3. Allergy Disclaimer

3.1 While we take great care to accommodate dietary requirements, all products are made in a kitchen that handles gluten, dairy, eggs, nuts, soy, and other allergens. We cannot guarantee the absence of trace allergens.

3.2 Spodeli accepts no liability whatsoever to any allergic reaction by a Customer as a result of consuming a Spodeli product. If you have guests who have allergies or intolerances, it is important to let them know that we do not guarantee an allergen free environment.

3.3 Spodeli provides products sourced from a wholesaler, catering to guests with allergies and dietary requirements. These items come frozen and are kept separate in our freezer until delivery/pickup.

4. Delivery / Travel / Pickup

4.1 Studio/Pickup Location: 34 Bulkara Street, Wallsend NSW 2287

4.2 For the correct delivery zone, input 'from Spodeli to .......' in your apple/google maps and select directions.

4.3 In case of selecting an incorrect delivery zone during the online ordering process, the invoice will be adjusted, and full payment is required BEFORE delivery.

4.4 Delivery fees from Spodeli (Wallsend NSW 2287) are as follows:

0-5 km (free*), 6-10 km (Zone 1) $20, 11-20 km (Zone 2) $30, 21-30 km (Zone 3) $45, 31-40 km (Zone 4) $65, 41-50 km (Zone 5) $80, 51-60 km (Zone 6) $120, 61-70 km (Zone 7) $140, 71-80 km (Zone 8) $160, 81-90 km (Zone 9) $180, 91-100 km (Zone 10) $200

4.5 Free zone delivery is for orders over $50, otherwise a $7 fee applies.

4.6 Please Ensure someone is available to accept the delivery. Spodeli will not leave your order unattended without written permission.

4.7 Upon delivery, in the event that no one is present and we are unable to reach the recipient or yourself, we will endeavor to wait as long as feasible prior to departing the premises.

4.8 Spodeli bears no liability for goods damaged post-delivery.

4.9 Should Spodeli find no suitable spot for delivery, we will return the order to the Spodeli Studio at Wallsend. The customer/recipient must then arrange for pick up. Failure to do so within the set timeframe given by us, it will result in order forfeiture with no refunds.

4.10 Delivery time frames are estimates and subject to change based on late studio pickups or other variables.

4.11 Spodeli will not be held responsible for any damage to the cake after it has left our premises. Customers should handle their cake with care and adhere to the storage and instructions provided to them.

4.12 Spodeli is open by appointment only. In the event of a customer failing to collect their cake at the designated time without communication, it will be forfeited without a refund.

5. Refunds and Store Credit Policy

5.1 At Spodeli, ordering must be done with care as refunds are not offered for changes of mind or cancellations.

5.2 In certain circumstances and at our discretion, Spodeli will offer you a store credit to be used on a future order.

5.3 Store Credit Conditions:ย 

  • Store credit is issued in lieu of a refund.
  • Store credit will be valid for 6 months from the date of issue.
  • It is non-transferable and cannot be redeemed for cash.
  • Store credit will not be issued for missed pickups.
  • Store credit will not be issued for orders cancelled within 14 days of delivery/pickup.ย 

5.4 All purchases are final and can only be returned if defective.

5.5 In case of any problems with your order, kindly reach out to us within 24 hours of receiving your product for resolution. No refunds will be provided for consumed cakes. If you suspect an issue with your cake, return at least 80% to Spodeli for inspection.

5.6 In the event that Spodeli is unable to fulfill your order, we guarantee that our customers will not be left at a loss. A full refund will be provided to the customer, demonstrating our commitment to customer service and transparency.

5.7 Our accountability is constrained to the expense of the item/s purchased. We are not responsible for any indirect, consequential, or incidental damages.

6. 'Save The Date' Policyย 

6.1 The 'save the date' deposit is subtracted from the total balance of your order upon finalization.

6.2 The remaining balance will be invoiced for payment no later than two (2) weeks prior to delivery/pickup.

6.3 In the case of event cancellation or postponement, deposits are forfeited and the date is no longer guaranteed.

6.4 Your 'save the date' deposit is not transferable to another date.
Buying a 'save the date' does not guarantee current cake pricing. While our pricing structure remains relatively stable, please note that cake prices are subject to occasional adjustment based on market factors. When finalizing your order details, your invoice will reflect current pricing, which may differ from previously published rates or quotations. This industry-standard pricing approach allows us to maintain consistent quality while accommodating fluctuations in ingredient costs and production requirements.

6.5 After securing your date with our 'Save The Date' deposit, you maintain complete control over when to proceed with quote finalization. Upon your request, we will prepare a quote including all delivery charges if applicable and generate your final invoice, which becomes payable immediately upon receipt. Please note, Spodeli requires this finalization process to be completed a minimum of fourteen (14) days prior to your designated delivery or pick up.

7. Afterpay and Zippay

You are only eligible to receive a full refund via Afterpay or ZipPay if the goods are faulty.ย 

8. Gift Cards

8.1 Gift Cards expire after three (3) years from purchase.ย 

8.2 Lost or stolen cards cannot be replaced or converted to cash.

9. Food Handling

9.1 To maintain freshness, refrigerate each box of perishable foods until ready to serve.

9.2 We do not assume liability for any loss or damage resulting from improper handling or placement of our platters post-delivery.

10. Product Changes

10.1 Every grazing box is distinct with produce based on availability and season. All boxes are elegantly packaged with a personalized gift card for any event.

10.2 For custom orders, kindly reach out with your specific requirements for further discussion.

10.3 Spodeli may replace products and items if our usual items are unavailable. All replacements are of comparable value and quality.
